Section 702.0102 of the Board of Regents Policy Manual defines auxiliary enterprises in terms of budget authority, specifically classifies intercollegiate athletics as an auxiliary enterprise, and further states that the budgetary management of these enterprises rests with the institutions. Moreover, the Statutes of University (see Article II) articulate the President's authority and responsibility. “The President shall be the executive head of the institution and of all departments, a member of the Faculty, and the graduate faculty, and shall exercise such supervision and direction as will promote the efficient operation of the institution.”3 As a department of the University, Athletics operates under an established set of checks and balances. The president, the faculty athletic representative to the National Collegiate Athletic Association (NCAA), the University Athletics Committee, and the Athletics director ensure institutional control and compliance with the NCAA state and federal rules and regulations. The University's organizational chart shows Athletics reporting directly to the President through the Vice President of Business and Finance.

In its Bylaws , the NCAA details institutional control for intercollegiate athletics in Article 6 (p. 49). Specifically, Article 6.01.1 states: “The control and responsibility for the conduct of intercollegiate athletics shall be exercised by the institution itself and by the conference(s), if any, of which it is a member. Administrative control or faculty control, or a combination of the two, shall constitute institutional control.” Article 6.1.1 reads: “A member institution's chief executive officer has ultimate responsibility and final authority for the conduct of the intercollegiate athletics program and the actions of any board in control of that program.”
